Wills and Estate Planning

  • Why do I need a Will?

We believe that every adult should have a Will. A Will allows you to have your say about who will inherit your property and your possessions when you pass away. It also allows you to express your wishes regarding funeral arrangements, whether you wish to be buried or cremated.

It also allows you to appoint a Guardian to care for any children who are under 18 years. Having a Will can also help those that you leave behind. By appointing an Executor, you are giving clear authority to that person to deal with your estate in accordance with your Will.

  • What happens if I die without a Will?

The Succession Act 2006 (NSW) outlines what will happen to your property in the event that you die intestate (without a Will). There is a strict hierarchy as to who will inherit your property on intestacy; this may or may not be how you would like your property to be distributed.

  • My situation is a little more complex; what do I need to do?

At Direct2U Law & Conveyancing, we recognise that each person has different needs when it comes to preparing their Will. You may be part of a blended family; you may be in the process of separating; you may have vulnerable beneficiaries, such as those with a disability. We will discuss your situation with you, advise you and prepare a Will that best suits your unique situation.

  • What other documents should I consider when making my Will?

An "Enduring Power of Attorney" allows you to appoint an Attorney or Attorneys to manage all of your financial and legal affairs in the event that you are unable to do so. An "Appointment of Enduring Guardian" allows you to appoint a Guardian or Guardians to make medical and healthcare-related decisions for you, should you not have the capacity to do so yourself.
